Family Law Amendment (Family Violence and Cross-examination of Parties) Bill 2018 (July 2018)
Women's Legal Services Australia has made a submission in response to the Family Law Amendment (Family Violence and Cross-examination of Parties) Bill 2018. In the submission we welcome a ban on direct cross examination of victims-survivors by their alleged abuser. However, the protections offered by this Bill can only make a real difference with:
- proper funding to ensure that both the victim and the perpetrator have a legal representative to act on their behalf and conduct the cross-examination properly for them; and
- further reform to improve the understanding of the family law courts and all professionals within the system of dynamics of family violence and trauma informed and trauma based responses.
